Britney’s Attorney To Judge: ‘You’re Not A Pop Star’
Attorneys for Britney and Kevin were back in court Thursday morning as the star couple’s custody battle rages on.
Anne Kiley (Britney’s attorney) and Kevin’s lawyer Mark Vincent Kaplan went before the judge today, with the big issue at hand reportedly being Britney’s failure to follow drug and alcohol testing protocol.
According to Kaplan, there have been 14 drug tests Britney has been called to take, and she hasn’t responded for eight of them.
Kiley argued that the hour Britney is given to respond to the call from the testing center is unreasonable, and suggested her client be allowed a six-hour window to respond to the call for the random tests.
Additionally, Kiley called the current drug testing procedure “unconstitutional,” saying that just because Britney might not respond to testing calls, doesn’t mean she’s using drugs.
Britney’s attorney argued that the pop star shouldn’t be held to the same set of standards and deserves to be treated differently.
“With all due respect your honor, you’re not a pop star with a number one album,” Kiley told LA Superior Court Commissioner Scott Gordon, causing Kaplan to throw up his arms and laugh, according to our courtroom source.
The judge said it was “ludicrous” to ask a lab tech to be on standby for six hours just to have Britney call back.
“In all the years I’ve done this, I’ve never had to do that,” Gordon told Kiley.
Kiley said she would call the drug testing facility to inquire about changing the procedure.
Commissioner Gordon granted an hour recess for Kiley to call.
Both sides headed back into court shortly after 10:30AM and Gordon gave both sides until Tuesday to reach an agreement on future drug testing procedures.
If no agreement has been reached by the time Britney and Kevin’s attorneys return to court on Tuesday, Gordon will issue his own instructions.
Until then, the current system was left in place for Britney to be notified of her random testing, and she has one hour to respond after she is called to take a test.
Following the hearing, Kiley told Access Hollywood she had contacted the testing center, but was unable to get the information she needed and she is still working on it.
No word if Britney and Kevin would be required to appear in court on Tuesday.
